El caso de Cerro Matoso fue decidido por la Co=
rte Constitucional de Colombia en sentencia T-733 de 2017=2C en donde se e=
ncontraron violaciones al derecho fundamental de consulta del que gozan co=
munidades =C3=A9tnicas y da=C3=B1os en su salud=2C irregularidades en la l=
icencia ambiental otorgada y da=C3=B1os ambientales. Si bien=2C en 2018 a=
trav=C3=A9s del Auto 616/18 la Corte Constitucional declar=C3=B3 parcialm=
ente la nulidad de ciertas medidas adoptadas=2C se mantuvo el amparo a los=
derechos fundamentales. En este art=C3=ADculo se analizan los principales=
problemas en el proceso de otorgamiento y ejecuci=C3=B3n de la licencia a=
mbiental=2C que fueron los siguientes:
