 los procesos judiciales ha producido un incremento en el ingreso de solic=
itudes al Poder Judicial. Asimismo=2C ha brindado un soporte inconmensurab=
le durante la pandemia=2C atendido a que ha contribuido para la realizaci=
=C3=B3n de gestiones esenciales. Tanto es as=C3=AD=2C que incluso ahora se=

El C=C3=B3digo de Comercio regula los efectos derivados de la terminaci=C3=
=B3n del contrato=2C entre los art=C3=ADculos 1324 a 1327=2C que se pueden=
 resumir en: prestaciones a la terminaci=C3=B3n del contrato (con y sin ju=
sta causa); y derechos de retenci=C3=B3n y privilegio. Entre ellas=2C mere=
cen especial comentario las prestaciones consagradas en el art=C3=ADculo 1=
324 del C=C3=B3digo. En la primera parte=2C la norma dispone una prestaci=
=C3=B3n que es debida al agente a la terminaci=C3=B3n del contrato=2C sin=
 que se haga alusi=C3=B3n a causa especial alguna. Basta que el contrato l=
legue a su fin para que se deba la prestaci=C3=B3n mencionada. La segunda=
 prestaci=C3=B3n se debe cuando el empresario revoca o termina unilateralm=
ente el contrato=2C sin justa causa comprobada.

El objetivo de este art=C3=ADculo es mostrar las diversas interpretaciones=
 que ha hecho la jurisprudencia de la Corte Suprema de Justicia con respec=
to a la posibilidad de renunciar o no a dichas prestaciones. El art=C3=ADc=
ulo demuestra que la postura de la Corte Suprema de Justicia en relaci=C3=
=B3n con la irrenunciabilidad de la denominada =E2=80=9Ccesant=C3=ADa come=

                            El C=C3=B3digo de Comercio regula los efectos=
 derivados de la terminaci=C3=B3n del contrato=2C entre los art=C3=ADculos=
 1324 a 1327=2C que se pueden resumir en: prestaciones a la terminaci=C3=
=B3n del contrato (con y sin justa causa); y derechos de retenci=C3=B3n y=
 privilegio. Entre ellas=2C merecen especial comentario las prestaciones c=
onsagradas en el art=C3=ADculo 1324 del C=C3=B3digo. En la primera parte=
=2C la norma dispone una prestaci=C3=B3n que es debida al agente a la term=
inaci=C3=B3n del contrato=2C sin que se haga alusi=C3=B3n a causa especial=
 alguna. Basta que el contrato llegue a su fin para que se deba la prestac=
i=C3=B3n mencionada. La segunda prestaci=C3=B3n se debe cuando el empresar=
io revoca o termina unilateralmente el contrato=2C sin justa causa comprob=
ada.<br>

El objetivo de este art=C3=ADculo es mostrar las diversas interpretaciones=
 que ha hecho la jurisprudencia de la Corte Suprema de Justicia con respec=
to a la posibilidad de renunciar o no a dichas prestaciones. El art=C3=ADc=
ulo demuestra que la postura de la Corte Suprema de Justicia en relaci=C3=
