<p>INTER@SJUDINET LTDA LE OFRECE PRESENTAR RECLAMACIÓN PARA EL PERSONAL DEL NIVEL EJECUTIVO DE LA POLICIA NACIONAL ACTIVOS Y PENSIONADOS, UN PROCESO DE RECLAMACIÓN DEL SUBSIDIO FAMILIAR QUE SE LE ADEUDA A USTED POR EL SOLO HECHO DE PERTENECER O HABER PERTENECIDO AL NIVEL EJECUTIVO, SER CASADO O TENER COMPAÑERA PERMANENTE E HIJOS.</p>
<p>LA POLICÍA NACIONAL COMO UNA SOLA INSTITUCIÓN TIENE DENTRO DE SU PERSONAL UNIFORMADO CINCO CUERPOS: PERSONAL DE OFICIALES, PERSONAL DE SUBOFICIALES, PERSONAL DE AGENTES, PERSONAL NO UNIFORMADO Y PERSONAL DEL NIVEL EJECUTIVO.</p>
<p>LA INSTITUCIÓN LE VIENE PAGANDO EL SUBSIDIO FAMILIAR A LOS PRIMEROS CUATRO CUERPOS, PERO AL PERSONAL DEL NIVEL EJECUTIVO ÚNICAMENTE EN SERVICIO ACTIVO, DENTRO DE SU SALARIO LE ASIGNAN UNA PARTIDA POR ESTE CONCEPTO COMO ESPECIE DE UNA COMPENSACIÓN ECONÓMICA POR $31.319, SIN PORCENTAJES Y REQUISITOS ESPECÍFICOS, IGUALMENTE DICHA PARTIDA NO ES INCLUIDA PARA EFECTO DEL PAGO DE LAS PRESTACIONES SOCIALES Y DE ASIGNACIÓN DE RETIRO.</p>
<p>A LOS PRIMEROS CUATRO CUERPOS Y POR ESTATUTOS DE CARRERA LE CANCELAN EL 30% POR SU ESPOSA O COMPAÑERA PERMANENTE, UN 5% POR SU PRIMER HIJO Y UN 4% POR CADA HIJO HASTA COMPLETAR EL 17%, PARA UN TOTAL HASTA EL 47% SOBRE LA ASIGNACIÓN BÁSICA MENSUAL .</p>
<p>POR DERECHO A LA IGUALDAD, A LA LEY 1098 DE INFANCIA Y ADOLECENCIA, EL PERSONAL DEL NIVEL EJECUTIVO TIENE DERECHO A QUE SE LE RECONOZCA Y PAGUE DICHOS HABERES CON RETROACTIVIDAD.</p>

<p>EL DECRETO QUE CREÓ EL NIVEL EJECUTIVO FUE DECLARADO NULO, LEY 62 DEL AÑO 1993, POR LO TANTO QUEDO SIN PISO JURÍDICO Y EN CONSECUENCIA SE DEBE APLICAR LA NORMA VIGENTE EL DECRETO 1212 DE 1990.</p>
<p>SE REQUIERE DEMANDAR LA RESOLUCIÓN QUE LÍQUIDAR LAS CESANTÍAS AL MOMENTO DE PRODUCIRSE EL RETIRO, EL CÚAL SE TIENE UN PLAZO MÁXIMO DE CUATRO MESES A PARTIR DE LA NOTIFICACIÓN.</p>

<p>EL OFICIAL O SUBOFICIAL DE LA POLICÍA NACIONAL QUE DURANTE LA VIGENCIA DE ESTE DECRETO SE RETIRE O SEA RETIRADO DEL SERVICIO ACTIVO POR CUALQUIER CAUSA, TENDRÁ DERECHO A QUE EL TESORO PÚBLICO LE PAGUE, POR UNA SOLA VEZ, UN <span>AUXILIO DE CESANTÍA IGUAL A UN MES DE HABERES CORRESPONDIENTES A SU GRADO POR CADA AÑO DE SERVICIO O FRACCIÓN DE SEIS (6) MESES O MÁS.</span></p>
<p>TOMANDO COMO BASE LAS PARTIDAS SEÑALADAS EN EL <span>ARTÍCULO 140</span> Y A LAS INDEMNIZACIONES QUE LEGALMENTE LE PUEDAN CORRESPONDER LIQUIDADAS IGUALMENTE CONFORME AL CITADO ARTÍCULO.</p>
